Surge POS Text Message Terms

These terms cover the text messages that Discover Data Direct LLC dba “Surge POS” (“Surge,” “we,” “our” or “us”) sends on behalf of the shops, restaurants and other businesses that use Surge POS (“the shop”). By giving your mobile number at a shop for one of the texts below, you agree to these terms.

1. The texts

The program is Surge order and receipt texts, sent by Discover Data Direct LLC dba Surge POS. Every text names the shop it is from, and the first text to a number ends with “Reply STOP to opt out.” There are two kinds, and no others:

• Order ready: when you give a mobile number with an order, one text when the order is ready. For example: “Your order 42 at Bean Co is ready.”
• Receipt: when you ask for your receipt by text, one text with a link to it. For example: “Bean Co: your receipt for order 42: https://api.surgeups.com/r/…”

2. How you sign up

The texts are sent by Discover Data Direct LLC dba Surge POS, for the shop where you gave your number. You sign up by giving your mobile number at the shop for one particular text. There are three places this happens, and in each one you are told, before the number is entered, who sends the text, how many texts you will get, that message and data rates may apply, how to stop and get help, and where these terms and our Privacy Policy are. Giving a number is optional and is never a condition of buying anything.

a. Ordering kiosk (order ready)

You type your number yourself in the optional phone box on the kiosk’s order page. Above the box it says: “Optional. We will text you once, when your order is ready. Texts from Surge POS. Msg & data rates may apply. Reply STOP to opt out, HELP for help. Terms: surgeups.com/terms Privacy: surgeups.com/privacy”

b. Register (order ready)

At the counter, the cashier asks for a name for the order. If you want a text, you give your number and the cashier types it in the optional “Phone to text” box. Under the box, on the screen facing the cashier, it says: “We will text this number once, when the order is ready. Texts from Surge POS. Msg & data rates may apply. Reply STOP to opt out, HELP for help. Terms: surgeups.com/terms Privacy: surgeups.com/privacy”

c. Receipt by text (register or kiosk)

After paying, you can ask for your receipt by text instead of on paper or by email. At the register, the screen asks for your mobile number and says: “We will text a link to your receipt. Texts from Surge POS. Msg & data rates may apply. Reply STOP to opt out, HELP for help. Terms: surgeups.com/terms Privacy: surgeups.com/privacy” At the ordering kiosk, under the receipt box: “A mobile number is texted a link to the receipt. Texts from Surge POS. Msg & data rates may apply. Reply STOP to opt out, HELP for help. Terms: surgeups.com/terms Privacy: surgeups.com/privacy”

3. How often

Message frequency varies with how often you ask: usually one text per order or receipt. We do not send texts between 9pm and 8am, shop time, unless you placed the order or asked for the receipt in the last two hours.

4. Cost

Surge and the shop do not charge for these texts. Message and data rates may apply, according to your mobile plan.

5. Stopping texts, and help

• Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT) to any text to stop all texts sent through Surge, from every shop. You will get one text confirming it, and no more. This includes receipts you ask for later.
• Reply START to turn them back on.
• Reply HELP for help, or email info@surgeups.com.

6. Delivery

Carriers are not liable for delayed or undelivered messages. A text that does not arrive is not sent again; the shop can still tell you in person, print your receipt or email it.

7. Privacy

Your number is used only to send the text you asked for, and to honor a STOP. Mobile numbers and text-messaging opt-in data and consent are never shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for more.

8. Changes and contact

We may change these terms. Changes are effective as soon as we post them here.
